In the state of Texas, an adult who wishes to change his or her name must be a resident of Texas for at least six months and must file a Petition in the District Court of the county where he or she resides and must be a resident of said County for at least ninety days as detailed above. The Petition informs the Court of the Petitioner's name, the name the Petitioner wishes to assume, the reasons for the change and other personal information required by statute. The Petition must be notarized.

A party filing a Petition for name change for an adult shall present to the District Court, upon filing of the Petition, a set of fingerprints of the person whose name is to be changed. The Petitioner shall be responsible for the costs of obtaining fingerprints and other costs which may be incurred upon filing.

Once you file your Petition for name change, you should schedule a time to ask the Judge to approve your name change. At this time, the Court shall proceed at chambers to hear and determine all matters raised by the Petition and to render final judgment or decree thereon. The Court may then proceed to enter an Order of approval of name change.

The granting of a Petition for change of name is discretionary with the Court, and the Court may deny a Petition on grounds, which would not constitute lawful objection. For an Order of name change to be granted, the Court must find sufficient reasons for the change and also find the name change in the interest or to the benefit of the Petitioner and in the interest of the public. A person is not allowed to change their name in order to avoid judgments or legal actions against him or her, or to avoid debts and obligations. A person cannot change their name to defraud another person.

Statewide Patrol can provide you with any number of our well-trained officers that would be necessary for the protection of your property. A veteran field officer and management personnel will work together with you to create a custom set of Post Orders for your property. These Post Orders are a set of mandatory duties which our officers must execute every shift. A field supervisor will train, on-site, all officers assigned to your property. For every work shift on your property, our officers write a Daily Officer Report (DOR). A DOR. is a detailed account of your officer�s activities throughout his or her shift. Statewide Patrol�s officers are also ready with special forms, which supplement the DOR., and clearly bring to your attention any unusual activities on your property. These forms include: Incident Reports, Suspect Information Sheets, Safety Inspection/Hazard Form, Time Logs and more.

Patrol Services:

A uniformed Statewide Patrol officer arrives at your property and conducts walk through inspection lasting 15-20 minutes. You determine the number of visits and inspections per shift. This is not the typical security truck drive through. Our officers inspect your property on foot and write a report for each visit.

Remote Access Web Camera & Digital Video Recorders (DVR):

Statewide Patrol, Inc. installs state-of-the art security cameras which are either hard-wired or transmit their images wireless to a desktop or notebook computer. The system allows remote viewing and monitoring along with digital recording capabilities. ALL THE CAMERAS IMAGES ARE DIGITALLY RECORDED ONTO THE HARD DRIVE OF THE COMPUTER. The system is completely mainteance free and does not require the user to constantly change video tapes out, every few days, like the out-of-date analog time lapse VCRs do.

A digitally recorded security camera system can be used as a stand alone system and/or to enhance both our patrol and/or standing guard service.

A Digital Video Recorder (DVR) with a number of strategically placed security cameras can be installed at a client�s location and Statewide Patrol can monitor your system remotely or you can opt to just digitally record the images the cameras see. If Statewide Patrol personnel view an incident on the camera or a camera sends an alarm to the monitoring guard, a licensed officer is dispatched to the location immediately. If a broadband internet access is provided on both the DVR end aswell as the remote end the cameras can be viewed remotely via the internet.

The Digital Video Recorder (DVR) is capable of operating as few as two(2) cameras or as many as sixteen(16). In addition, Statewide Patrol, Inc. has customized solutions that can operate as many as sixty-four(64) cameras. The Digital Video Recorder (DVR) is also capable of recording and storing live images. These images are time stamped and can be easily accessed in order to find a specific occurrence. The system can work with a host of indoor, outdoor and infrared (night) cameras. The cameras located at your location can also be viewed by you, using a standard Web browser from any PC in any remote location. The Digital Video Recorder (DVR) system uses military grade encryption and a patent-pending technology security solution to offer fully secure Web images. This ensures that all images are sent safely, and more importantly securely through the Internet. The remote viewing aspect allows Statewide to monitor your cameras up to 24 hours a day if necessary.

The Digital Video Recorder (DVR) can be customized to fit any size business with any size budget and can be purchased directly from Statewide Patrol. Lease packages with 12, 24, 36 or 48 months with a $1 buyout are also available for customers with approved credit.

Completed deferred adjudication, need help with your record

If you have successfully completed deferred adjudication, you may be eligible for a petition for non-disclosure. It is important to note that completion of deferred adjudication does not automatically seal your record; you must file a petition of non-disclosure to seal the record.
Eligibility: First, you must successfully complete your deferred adjudication probation.

If you completed deferred adjudication for a felony, 5 years from the date of the discharge must elapse before a petition for non-disclosure can be filed. For most misdemeanors, you can file immediately after completing the deferred adjudication. However, for some misdemeanors, you must wait 2 years after the date of discharge before seeking a petition for non-disclosure.

Misdemeanors that require a 2 waiting period include assault, deadly conduct, disorderly conduct, and unlawfully carrying a weapon. Contact me and I will let you know your waiting period.

Finally, you cannot have ever been convicted of certain offenses or placed on deferred adjudication for certain offenses. These offenses include any crime that requires registration as a sex offender, aggravated kidnapping, murder, injury to a child, stalking, and any offense that involves family violence.
Effect: If you are granted non-disclosure, criminal justice agencies will not be allowed to disclose information about the offense. Furthermore, you may deny that you were ever arrested, except in a future criminal prosecution.

Small Claims Cases

I have prepared many small claims cases. Here is how the process works:

The filing fee covers the filing fee and the sheriff serving the Defendant. The damages we can ask for can be up to $10,000.00. The first thing that we will do is file your Original Petition and pay the court costs/filing fees.

Step 2- Services of Process. A citation attached to your filed Petition will be served on the Defendant by a Constable or Sheriff's officer. The Citation tells the Defendant the deadline for answering the lawsuit. You should receive notice of the date that the Defendant was served. The Defendant's deadline to answer the Petition is 10 a.m. on the Monday following 10 days after the date of service. Which I will calculate for you.

Step 3 - Default Judgment or Contested Hearing: Your case is decided.
If the Defendant does not file an Answer to your Petition within the allotted time, you may receive a “Default Judgment.�� A Default Judgment. means that a short hearing will be held before the Judge without notice to the Defendant. We are asking the Judge to grant you everything we asked for in the Original Petition.

I will call the Court and schedule a time for your Default Hearing and prepare your documents and testimony in advance to show the judge exactly how you arrived at the amount of damages that you are claiming.

The Defendant can file an answer with the Court at any time before the judgment is entered. This answer will entitle the Defendant to a Contested Hearing. If a Contested Hearing is held, the Plaintiff has the burden of proving his or her claims to the Court.

* The Court will consider only testimony and other evidence available in the Courtroom at the time of the trial.
* Have copies of all the documents you intend to use at the hearing available for the Court and Defendant.
* Be aware that notarized statements fro m individuals, although admissible, have little value compared to live testimony.
* Involuntary witnesses may need to be subpoenaed (ordered to appear in court).

Step 4. Judge's Decision.
Step 5. Collection of the Judgment (if any). That I will help you recover.

Modify your Child Support Order

The only way to modify your existing Texas child support order is to return to court and specifically request a modification. The parents cannot decide between themselves that they will modify the child support payments. If the parents decide between themselves that they wish to modify the child support payments, they must submit a stipulation to the court. The court must then approve the stipulation and issue the order modifying the child support.

Either the custodial parent or the non-custodial parent may request a modification, but there must be a material and substantial change in circumstances. This means there is:

* A change in the custody of a child
* A raise or cut in the income of either parent
* Obligation of either parent to support other dependents such as children or elderly parents
* Additional unexpected medical or educational expenses

If there is only a minor change in circumstances, such as one parent being between jobs, the court may be unlikely to modify the child support order. Or, the court may order a temporary modification.

If you completed deferred adjudication, you may be eligible for an Order of Non-Disclosure. This would allow you to not report the criminal proceeding. Additionally, the records related to the matter would not be disclosed to most third parties.

This may mean:

� Removal of mug shot from official websites
� More hireablity
� Access to more housing
� End embarrassing background checks

Some offenses are not eligible for Orders of Non-Disclosure, including those for family violence, sexual assault, and those involving children. For most misdemeanors, the offense is eligible for non-disclosure immediately upon completion of deferred adjudication. For some misdemeanors, there is a waiting period of 2 years after the deferred adjudication. The waiting period is 5 years for all felonies.

There are additional requirements and the facts of your case may make the petition more complex to handle.

There are fees required to file the case with the court and to mail the orders to different law enforcement agencies that hold your records. In Travis County, the cost to file the case is $242.00. The cost to mail the order to a single agency is $15.00. Depending on the facts of your case, the order may be mailed more than a dozen agencies. The court fees could total more than $422.00.

I charge a flat fee of $250 to draft your petition. If you require me to appear at the hearing with you, and many people do not, there is an additional fee. For $1100, including court fees, I will draft the motion and represent you in court.
